Terms and conditions

The website at www.chance2.dance (our website) is owned and operated by CHANCE2DANCE Live Limited. For further details about CHANCE2DANCE, please see the end of these terms.

 

Part 1 of these terms sets out the terms that apply to all tickets purchased from CHANCE2DANCE whether in person, by telephone or online.

 

Part 2 of these terms sets out the additional terms that apply to all dance schools and performers taking part in any CHANCE2DANCE event.

 

These terms and conditions apply to tickets for performances and events and references in these terms to 'performances' will also include events.  In these Terms & Conditions, the “Organiser”, “Us”, “Our”, or “We” means CHANCE2DANCE Live Limited.

 

Part 1: Terms applying to all tickets purchased from CHANCE2DANCE

1. Ticket exchange and resale
1.1 Once purchased, tickets cannot be transferred, exchanged, refunded or returned unless the event is cancelled.

2. Rules of admission

  • There is no admission to the event without a ticket.
  • You need a valid ticket, which must be produced on arrival in order to enter the event.
  • Please check carefully the venue, date and time printed on the front of your ticket as mistakes cannot always be rectified after the booking has been confirmed.  It is the responsibility of the ticket holder to ascertain the date and time of any rearranged event.
  • The advertised running time may change so please check with the CHANCE2DANCE production team on the day of the performance.
  • We reserve the right to refuse admission in reasonable circumstances or to request any ticket holder to leave the venue and take appropriate action to enforce this right.
  • We reserve the right to refuse admission or to eject a ticket holder any person appearing to be intoxicated, under the influence of drugs, or otherwise behaving dangerously or inappropriately, for any other behaviour likely to cause damage, injury, nuisance and annoyance or for failure to comply with the reasonable request of the Organiser.
  • Children under the age of 16 must be accompanied by a paying adult.
  • If you arrive later than the advertised start time or you need to leave the auditorium for any reason then you may be asked to wait until a suitable break in the performance before you can take your seat. This may be the interval.  The Organiser would advise customers that no refunds will be offered to customers who are refused entry or ejected from a venue on account of late arrival.
  • We cannot guarantee that you will be seated in the seat that was selected by you during the booking process. Our management team reserve the right to move you to a different seat in the event of any disputes.
  • To ensure our audience safety CHANCE2DANCE may conduct occasional security searches which may include searching your bag before entering the event.
  • Your ticket can only be refunded in the event that the performance is cancelled. Details of our Ticket Exchange and Resale Policy are set out above.
  • In the event of a cancelled performance or a performance that has to be abandoned part way through, we will not be liable for additional travel or accommodation expenses.
  • Reselling your ticket for profit or commercial gain makes it void.
  • We reserve the right to make alteration to the advertised details for the performance at short notice (for example, changes to the running order). In these instances CHANCE2DANCE is not obliged to refund the ticket or exchange.
  • On occasions the performance or public areas may be filmed, sound recorded or photographed. Buying a ticket affirms your consent to the filming, sound recording and/or photography of yourself as a member of the audience and the use, reproduction, storage, distribution and broadcasting of such films and recordings (including any copies made) without payment.
  • Neither the Organiser nor the venue operator will be responsible for any loss, damage, death or injury howsoever caused unless (i) the relevant party has breached its legal obligations; and (ii) such loss or damage is a direct and reasonably foreseeable result of the breach.  For the avoidance of doubt, the Organiser will not be responsible for the actions of any third party, including but not limited to, the exhibitors.  Subject to this and with regard to personal property brought to the venue, the liability of the relevant party shall be limited to the reasonable cost of either repairing or replacing such personal property, subject to fair wear and tear.
  • The unauthorised use of cameras, videos or any other sort of audio or visual recording equipment is strictly forbidden.
  • Mobile phones, pagers and digital watches must be turned off at all times in the auditorium.
  • Babes in arms are admitted to the auditorium but you must make CHANCE2DANCE aware of this at the time of booking your ticket, so that we can keep an accurate record of the number of people in the venue.
  • All children over 2 years of age must occupy their own seats and purchase a separate ticket.
  • Strobe lighting, smoke effects, loud bangs and shots are sometimes used in productions.
  • For Health & Safety reasons, wheelchair users are not permitted to transfer into fixed seating.
  • You may not take drinks in glasses into the venue. Plastic cups are available for any cold drinks and may be taken in.
  • Animals (with the exception of registered assistance guide dogs for the blind) are not admitted to the venue.
  • The sale of articles or distribution of leaflets in the gangways or anywhere on the exhibition premises is strictly prohibited except with the written permission of the Organisers. The Organisers reserve the right at their absolute discretion to confiscate any such articles for infringement of this condition. 

 

3. Information about purchasing tickets from the CHANCE2DANCE website
3.1 The website at www.chance2.dance (our website) is owned and operated by CHANCE2DANCE Live Limited (“CHANCE2ANCE”). For further details about CHANCE2DANCE, please see the end of these terms.

 

3.2 This page and any documents referred to on it tell you the terms and conditions on which we supply tickets to you from our website (Tickets). Please read these terms carefully before ordering any Tickets from our website as, by doing so, you accept these terms and conditions.

 

3.3 You will need to click the box marked 'I confirm I have read and agreed to the terms and conditions of this show' in the course of your purchase of Tickets to confirm your acceptance of these terms. If you don't accept these terms, you will not be able to order any Tickets from our website.

 

3.4 You should print a copy of these terms for future reference.

 

4. Payment details, prices and delivery
4.1 The price of any Tickets will be as quoted on our website, except in cases of obvious error. 

4.2 The prices include any VAT applicable, but exclude any postage costs. 

4.3 If you are under 18 years old you may purchase Tickets only with the involvement of your parent or guardian.

4.4 Payment for all Tickets must be by credit or debit card or via PayPal. We accept all major credit and debit cards and we will not charge your credit or debit card until we confirm your order.

4.5 All Tickets purchased on our website or via phone are electronic tickets (e-tickets) and will be sent to you via email.  You should print your tickets and present them upon arrival at the event, or where the venue allows you can also show them on a smartphone or similar electronic device.  Each e-ticket contains a unique QR code that will allow the ticket to be verified upon arrival to the venue.

4.6 We will not accept any responsibility for tickets that are mislaid but it should be possible to get duplicate tickets from the CHANCE2DANCE system if you speak to a member of the production team.  Duplicates can only be provided to the cardholder upon production of the card that was used to make the booking.

4.7 In the event that your tickets are lost through technical error duplicates can be provided at the box office and these will only be given out to the cardholder upon production of the card that was used to make the booking.

4.8 If tickets that are emailed are returned to the organiser due to incorrect email address provided, we reserve the right to cancel the order.

4.9 It is the responsibility of the ticket holder to check all tickets upon receipt, as mistakes cannot always be rectified at a later date.


5. How the contract is formed between you and us 
5.1 After placing an order, you will receive an email from us acknowledging that we have received your order and confirming whether or not we can accept that order. The contract between us (Contract) will be formed when we send you an acknowledgement email which confirms our acceptance of your offer to purchase the Tickets. 

5.2 The Contract will relate only to those Tickets indicated in the acknowledgement email. We will not be obliged to supply any other Tickets which may have been part of your order until acceptance of your order for those tickets has been confirmed in a separate acknowledgement email.

 

6. Links and disclaimer
We may provide links on our website to the websites of other companies, whether affiliated with us or not. We cannot accept any liability for tickets you purchase from companies to whose website we have provided a link on our website. This disclaimer does not affect your statutory rights against the third party seller. We will notify you when a third party is involved in a transaction, and we may disclose your customer information related to that transaction to the third party seller in order for the transaction to proceed.

 

7. Our liability
7.1 Our liability to you (whether in contract, tort (including negligence) or otherwise) is limited to the purchase price of the Tickets you have purchased. 

 

7.2 In the unfortunate event that a performance has to be cancelled or abandoned part way through, we will not be liable for any accommodation, travel or other costs you incur.  We will use best endeavours to contact purchasers either by phone, email or in writing (using the details provided at the time of ordering) and advise them to return the tickets. Please note, however, it is the customer's responsibility to check whether the event is going ahead at the scheduled date, time and venue, and CHANCE2DANCE cannot guarantee that they will inform the customer of any changes to the event date, time or venue.

 

7.3 If an event is moved from its advertised venue and / or the date is changed, tickets already purchased may remain valid should the customer wish to attend the revised event. If not, the Organiser will refund the face value of the tickets. The Organiser will notify all purchasers by phone, email or in writing (using the details provided at the time of ordering) to advise on the validity of the tickets and the procedure for obtaining a refund. Refund requests will usually be accepted up until 1 week prior to the revised event, or 3 days after notification of the change (whichever is the later) unless otherwise notified. In the event of a change at short notice (within 1 week of the event) the Organiser will notify purchasers of the conditions that apply, and offer a refund if these are not agreeable. Please note, however, it is the customer's responsibility to check whether the event is going ahead at the scheduled date, time and venue, and the Organiser cannot guarantee that they will inform the customer of any changes to the event date, time or venue.

 

7.4 If the Organiser is unable to fulfill an order for any of the reasons where the Organiser has acted with negligence or where we may have acted in breach of contract will be entitled to a full refund, including any booking fee charged.

 

7.5 It is the responsibility of the customer to inform the Organiser of any change of address, contact phone number or email address, both before and after receipt of their tickets. Please note that our preferred method of contact for customers booking online is by email, so care should be taken to provide a current, valid email address.

 

7.3 We will not accept liability for any indirect, special or consequential losses, including (for example) loss of profits, revenue, contracts, data or goodwill.

7.4 These terms of use do not affect your statutory rights as a consumer.

7.5 Nothing in these terms limits our liability for death or personal injury caused by our negligence or for any other matter for which it would be illegal for us to limit, or attempt to limit, our liability.

 

8. Written communications
Applicable laws require that some of the information or communications we send to you should be in writing. When using our website, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website and/or our social media outlets. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This section does not affect your statutory rights.

 

9. Notices
All notices given by you to us must be given to CHANCE2DANCE at 239 Stratford Road, Shirley, Solihull, West Midlands, B90 3AH or by email to info@chance2dancelive.com. We may give notice to you at either the email or postal address you provide to us when placing an order, or in any of the ways specified in section 8 above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an email is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an email that such email was sent to the specified email address of the addressee.

 

10. Events outside our control 
10.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control (Force Majeure Event). 

10.2 A Force Majeure Event includes any act, event, omission or accident beyond our reasonable control and includes (as well as others) such things as: terrorist attack, fire, flood or natural disaster, epidemics, impossibility of the use of means of public or private transport, or public or private telecommunications networks or the threat of any of these things. 

10.3 If a Force Majeure Event occurs, we may have to cancel a performance or abandon it part way through and our obligations to you are deemed to be suspended for the period that the Force Majeure Event continues. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations may be performed despite the Force Majeure Event. Please note section 7.2 above.

 

11. Other Matters 
11.1 We may transfer, assign, charge, sub-contract or otherwise dispose of any Contract at any time, but you may not do so without our prior written consent. 


11.2 If we fail to exercise any of our rights under any Contract, this will not amount to a waiver by us of those rights.

11.3 If any part of these terms or of any Contract is unenforceable, this will not affect the enforceability of any other part.

11.4 We intend to rely upon these terms and any document expressly referred to in them in relation to the subject matter of any Contract. 

11.5 Part 1 and Part 2 of these terms, together with any document referred to in these terms, constitute the whole agreement between you and us.

 

12. Changes
12.1 We may revise these terms of use at any time by amending this page. You should check this page from time to time to take notice of any changes we have made, as they are binding on you.

12.2 Any Contract will be subject to the terms in force at the time that you order Tickets from us, unless any change to these terms is required to be made by law or governmental authority (in which case it may apply to orders previously placed by you).

 

13. Law and jurisdiction
These terms and Contracts for the purchase of Tickets through our website will be governed by English law. Any dispute over or claims arising from these terms or any Contracts will be subject to the exclusive jurisdiction of the English courts, although we retain the right to bring proceedings against you for breaking these terms or any Contract in your country of residence or any other relevant country.

14. Snow Policy

Where snow or other adverse weather conditions are likely to affect a CHANCE2DANCE event the following policy applies:

Where snow or other adverse weather conditions prevent the CHANCE2DANCE team, the theatre/venue staff and/or the production crew from getting to work to the point that the show cannot go ahead, then the event would be cancelled, and customers will be entitled to a refund.  We try extremely hard to ensure the event goes ahead.  This is because we know from experience that our customers try hard to get to the venue, many are local and would not want to miss the show where possible.  Not everyone will be affected by snow.

Cancelled shows will be shown on our social media.  Keep hold of your tickets and receipts in order to claim any refunds.  Where we can, we may offer alternative dates/shows.

Where snow or other adverse weather conditions have not prevented the CHANCE2DANCE team, the theatre/venue staff and/or the production crew from getting to work then the show will go ahead.  CHANCE2DANCE regrets that some customers may be unable to get to the event, due to either their own location or travel plans, however in line with all other entertainment venues and concert providers, we are not able to offer refunds to customers who cannot get to the event, as weather is not in our control.  Where we can, we may offer alternative dates/shows.

Please be assured we make every effort to monitor snow reports and work closely with the venue to ensure it is safe to operate our events.

 

Part 2: Additional Terms applying to dance schools and performers taking part in any CHANCE2DANCE event

 

1. Theatre events - registration

 

1.1 All performers taking part in a CHANCE2DANCE theatre event are required to complete the online registration process and pay a registration fee of £25.00.

 

1.2 The registration process should be completed no later than 6 weeks prior to the date of the event.  If a performer has not registered by this time, CHANCE2DANCE reserve the right to exclude the performer from the performance and/or the programme. 

 

1.3 The registration process should be completed by a parent or guardian if the performer is under the age of 18 years.  The parent or guardian completing the registration process accepts the terms and conditions placed upon the performer on their behalf.

 

1.4 Performances by children are governed by The Children and Young Persons Acts 1933 and 1963, and The Children (Performances and Activities) (England) Regulations 2014. Unless the performer, their parent/guardian or the relevant dance school makes CHANCE2DANCE aware that a particular performer requires a licence to perform in a CHANCE2DANCE event, CHANCE2DANCE will assume that a licence is not needed and will, where a performer is under the age of 16, use the information obtained in the registration process to apply to the local authority for a licence exemption.  All licence exemption applications must be made at least 21 days before an event, therefore, should a performer under the age of 16 not complete the registration process within the time frame specified in 1.2 above CHANCE2DANCE reserve the right to request that the performer obtain their own licence exemption from their local authority and if necessary, exclude the performer from the performance.

 

1.5 Dance schools are responsible for ensuring that all of their students have completed the registration process and chasing any performers that haven’t done so.

 

2. Theatre events - Minimum ticket allocation

 

2.1 Upon completing the registration process to take part in a theatre event with CHANCE2DANCE the performer agrees to and is responsible for selling a minimum of 2 tickets for the theatre event they are registering for.

 

2.2 The minimum ticket requirement is applied on a per family basis, therefore any siblings involved in a theatre event are required to sell a minimum of 2 tickets on behalf of the family.

 

2.3 The minimum ticket allocation should be met no later than 2 weeks prior to the date of the theatre event.  Where this has not been done, CHANCE2DANCE reserve the right to contact the performer (or their parent/guardian) directly to remind them to buy their minimum ticket allocation.  CHANCE2DANCE will also make the dance school aware that their ticket allocation has not been met. 

 

2.4 If the minimum ticket requirement has not been met by the day of the event, CHANCE2DANCE reserve the right to take the performer out of the show.  CHANCE2DANCE also reserve the right to deny the opportunity for a dance school to perform in a future theatre event based upon the dance school not meeting their minimum ticket requirement in a previous show.  If a performer is taken out of a show due to not meeting their minimum ticket allocation, no refunds will be given to any performers within the same dance school if they choose not to perform in the show or because the dance school’s performance is affected due to missing a performer.  

 

2.5 If the minimum ticket requirement is not met on the day of the show, CHANCE2DANCE may seek to claim back this cost from the performer or the dance school.  The amount sought to reclaim will be the minimum cost of purchasing 2 tickets for the show the performer was involved in e.g. 2 concession tickets in the lowest band of tickets.

 

3. Theme Park events

 

3.1 The theme park and CHANCE2DANCE cannot take any responsibility for the young performers during their visit to the theme park.

 

3.2 It will be the responsibility of parents and principals to properly chaperone the children during their visit to the theme park.  We would suggest that anyone under the age of 12 has a parent or guardian with them at all times.  Anyone under the age of 16 should have a chaperone or troupe leader to report to during the day. The recommended ratios are 1 chaperone per 12 children for 12-16 year olds and 1 chaperone per 8 children for 5-12 year olds.
